Engagements for paid Services are governed by a separate written agreement between the Company and the Client. In the event of a conflict between these Terms and a signed engagement agreement, the signed engagement agreement controls. The Company reserves the right to decline any engagement at its sole discretion.

By submitting information through intake forms or assessment tools, you confirm you are authorized to provide the information, grant the Company a non-exclusive license to use it for delivering requested Services, and warrant that it does not violate any third-party rights or applicable laws.

7.1 Data Storage

Contact and communication data is stored in a secure CRM system (Supabase). Data is retained until you unsubscribe or submit a deletion request, subject to legal retention requirements.

7.2 Email Communications

If you submit an inquiry, you may receive follow-up email communications. All emails include an unsubscribe link. You may opt out at any time by clicking unsubscribe or contacting info@blanecanada.com.

7.3 California Privacy Rights (CCPA)

14. Governing Law

These Terms are governed by the laws of the State of Illinois. Any legal proceeding shall be subject to the exclusive jurisdiction of the courts located in DuPage County, Illinois.

15. Dispute Resolution

Mandatory Mediation. Before initiating any formal legal proceeding, the Parties agree to attempt good-faith resolution through non-binding mediation within DuPage County, Illinois, within 30 days of written notice of the dispute.

Arbitration. If mediation does not resolve the dispute within 60 days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, before a single arbitrator in DuPage County, Illinois. Exceptions. Either Party may seek injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

16. Reservation of Rights

The Company reserves the right to modify these Terms at any time. Continued use of the Site following any modification constitutes acceptance of the updated terms.
